OVERVIEW

Welcome to Artmellows Pty Ltd. The terms “we”, “us” and “our” refer to Artmellows Pty Ltd (also referred to as Artmellows 3D). We operate this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”). Our store is hosted on Shopify, which provides the ecommerce platform that allows us to sell our products and Services to you.

By visiting, browsing, purchasing, or otherwise using our Services, you agree to these Terms of Service and any policies referenced here, including our Privacy Policy and Refund Policy. If you do not agree, do not use the Services. Once you place an order with us, you are happy to comply with our Policies, Ts&Cs and Refund Policy.

1. ACCESS AND ACCOUNT

You must be at least the age of majority in your place of residence to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. You agree to provide accurate, current, and complete information, including billing and shipping details.

2. OUR PRODUCTS AND VISUAL ACCURACY

We do our best to display product images and colors accurately. However, colors and appearance may vary depending on device screens, lighting, and settings. Some images on our website may be concept renders or examples to demonstrate our sculpting style and capability.

Because our products are custom made, the final item may differ slightly from online images, previews, or concept designs.

3. CUSTOM MADE WORK AND LIKENESS DISCLAIMER

Most Artmellows products are custom designed and made to order, including digital sculpting, 3D printing, finishing, priming, and painting.

We aim for a reasonable likeness based on the photos and references you provide, but you acknowledge that:

• our work is an artistic interpretation

• 100 percent photographic duplication is not guaranteed

• minor variations are normal and are not considered defects

4. ORDERS, APPROVALS, AND PRODUCTION TIMEFRAMES

When you place an order, you are making an offer to purchase. We may accept or decline orders at our discretion, including where we suspect fraud, errors in pricing, or issues with supply or capacity.

Production timeframes vary depending on complexity and order volume. Our standard timeline is 10 to 12 weeks from final design approval and cleared payment, excluding shipping transit time.

• Simple projects may take 9 to 10 weeks

• Complex or large scale projects may take 10 to 12 weeks and very large projects like Life size , or many figurines/busts in One Order may take 3-6 months.

Timeframes may extend due to delayed approvals, requested changes, supply interruptions, or circumstances outside our control. If delays are expected, we will notify you.

If you have a deadline, you must tell us before ordering and receive written confirmation that we can meet it. We are not responsible for losses caused by deadlines not communicated and agreed in writing.

5. PRICES AND BILLING

Prices may change without notice. The price charged is the price shown at checkout at the time of purchase. Prices shown may not include taxes, shipping unless stated otherwise.

You agree to provide valid payment details and authorise us to charge the payment method used at checkout.

Customs duties, import taxes, and any additional fees imposed by your country are the responsibility of the customer. Artmellows is not responsible for delays or charges caused by customs clearance or import regulations.

6. CANCELLATIONS

You may request cancellation within 12 hours of placing the order for a full refund, provided Your project work has not started. We normally start working on the digital part of the project after 12 Hrs of placing irder.

This cancellation window does not apply to expedited or rush orders.

Once the work starts starts, the order cannot be cancelled.

7. REFUNDS AND RETURNS

Because our products are custom made to order, we do not offer refunds or exchanges once production has begun, under Australian Consumer Law.

This includes no refunds for change of mind, dissatisfaction based on personal preference, or minor variations consistent with custom production.

8. SHIPPING, TRANSIT DAMAGE, AND REPAIRS

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by couriers, customs, weather, strikes, or events outside our control.

If your item arrives damaged in transit, you must contact us within 48 hours of delivery with clear photos of:

• the damage

• the packaging

• the shipping label

Transit damage process:

• You must ship the damaged item back to us at your own cost. If its a Bigger figurine ( More than 80 cm)we will share the cost of shipping.

• We will repair the item and ship it back to you

• If the item is unrepairable, we will remake it and ship the replacement at our own cost

• Alternatevely, you can get it repaired locally if thats what is preferred or convinient then we contribuste resonable amout towards the local repair.

If your parcel arrives intact but you later request a replacement for reasons not caused by transit damage, additional shipping charges may apply, especially for items over 40 cm.

9. DECORATIVE USE ONLY

Our sculptures, including custom cars, bikes, portraits, figurines, awards, and related pieces, are decorative art objects only. They are not toys and not functional items. They are not mass manufactured diecast models and are not marketed as such.

10. INTELLECTUAL PROPERTY AND DIGITAL FILE RIGHTS

All content and materials on the Services, including designs, text, images, logos, digital sculpts, renders, and product designs are owned by Artmellows Pty Ltd or its licensors and are protected by intellectual property laws.

Unless agreed in writing:

• Artmellows retains exclusive ownership of the digital sculpt files and production files

• you may not reproduce, duplicate, resell, distribute, or commercially exploit our designs or digital files

• physical copies are for you or agreed recipients only, and further reproduction requires our written consent

Unauthorised use of our work may result in legal action.

11. MARKETING, PHOTOS, AND PRIVACY

We may photograph or film finished pieces for portfolio, marketing, and promotional use. We respect your privacy and will not publish private information such as the subject’s name or identifying details unless you provide explicit permission.

12. THIRD PARTY LINKS AND TOOLS

Our Services may include links or tools provided by third parties. We are not responsible for third party websites, content, or services. Use them at your own risk.

13. PROHIBITED USES

You agree not to use the Services for unlawful purposes, to infringe intellectual property rights, to harass others, to transmit malicious code, to scrape the website, or to attempt to gain unauthorised access to any systems.

14. DISCLAIMER OF WARRANTIES

To the extent permitted by law, the Services and products are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error free operation of the Services.

Nothing in these Terms excludes, restricts, or modifies rights you may have under Australian Consumer Law that cannot be excluded.

15. LIMITATION OF LIABILITY

To the extent permitted by law, Artmellows Pty Ltd is not liable for indirect, incidental, special, or consequential losses, including loss of profits or loss of opportunity.

Where liability cannot be excluded under Australian Consumer Law, our liability is limited to the maximum extent permitted by law.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time by posting changes on this page. Continued use of the Services after changes means you accept the updated Terms.

17. EU  Laws

Under applicable EU consumer protection laws, customers located in the European Union may have a 14 day right to cancel certain purchases.

However, this right does not apply to personalised or custom made products once production has commenced.

By approving a digital design, render, mockup, or custom artwork for production, the customer expressly acknowledges and agrees that they are requesting a bespoke product and waive any applicable cooling off or cancellation rights to the extent permitted by law. 

18.Production Timelines

Production timeframes vary depending on complexity and order volume. Our standard timeline is 10 to 12 weeks from final design approval and cleared payment, excluding shipping transit time.

• Simple projects ( Height up to 25 cm) may take 9-12 weeks

• Complex or large scale projects may take 3-4 Months  and very large projects like Life size , or many figurines/busts in One Order may take 5-7 months.

We Ship from Australia, Normally Standard Shipping via Australia Post. takes 9-25 working days to Reach.

 If the client needs the item sooner we take extra for Courier( We use Austpost-Express, UPS, DHL, Fedex or Pack&send Au ) Logistic Services to send the item safe and fast. Depending on the size and Volume we charge UPS Courier Shipping Charges.
